1. Annahme der Einkaufsbedingungen
1.1 Acceptance of Conditions. These Purchase Conditions are a continuing agreement between you and Nonsoloimmobili Srl, owner of the GSM Go brand and the GSM Go Auction website. They govern purchases of Inventory Products through this Site. By selecting the “I Accept the Purchase Conditions” checkbox, you accept and are bound by these Conditions. If you accept them for a company or other legal entity, you confirm that you are authorised to bind it.
1.2 Changes to Conditions. We may amend these Conditions with or without notice. For material changes, we will notify you through the Site, in-app messaging or email. Continued use means acceptance of the changes. You must keep your email address and contact details current.
2. Weitere Definitionen
2.1 Buyer or You means the individual or entity purchasing Inventory Products from GSM Go Auction through the Site.
2.2 A Completed Purchase occurs when all information requested in the Email Notification has been provided and GSM Go Auction has received the purchase price.
2.3 Inventory Products are products from the GSM Go Auction warehouse offered for sale on the Site under the conditions described in the relevant listing.
3. Auktionsverfahren
3.1 Inventory Products are offered “as is”. Their condition is described in the relevant listing; accessories may or may not be included as stated there.
3.2 To bid, the amount must exceed the applicable minimum and current winning bid, follow the stated increments and be entered before the scheduled closing time. Winning bidders receive an email at the address registered to their account and are responsible for keeping that address up to date.
3.3 A winning bidder must complete the purchase within two business days of the Email Notification. Otherwise GSM Go Auction may deactivate the account and either offer the lot to the next highest bidder or list it in a new auction.
4. Verkaufs- und Zahlungsbedingungen
4.1 The winning auction balance must be paid in full within 48 hours of closing, by bank transfer using the instructions in the listing or Email Notification. The Buyer bears all applicable taxes, shipping, handling and other purchase-related costs.
4.2 GSM Go Auction may refuse or cancel bids or purchases, including where product information, quantities or bids contain errors. Any cancellation will be notified by email.
4.3 Payment terms are those stated on the Site and in the Email Notification. Once payment is received, GSM Go Auction transfers its rights, title and interests in the relevant Inventory Products.
4.4 Before resale or disposal, the Buyer must remove identifying marks from the Products as required by GSM Go Auction and must not identify GSM Go Auction as their source or use its name in advertising.
5. Abholung und Annahme der Lagerprodukte
5.1 Purchased Inventory Products are available for collection at the GSM Go Auction location communicated after the auction. A Buyer collecting personally must arrange pickup and shipment and remove the Products within three business days of the availability notice.
5.2 Title remains with GSM Go Auction until the Buyer takes possession at the warehouse. Risk of loss passes upon receipt there. When our courier is used, goods are insured against theft and fire.
5.3 Possession constitutes unconditional acceptance; all sales are final, subject to the inspection right below.
5.4 The Buyer has five business days after delivery to inspect Products and report discrepancies in writing by email.
5.5 The parties shall take all actions reasonably necessary to transfer the Products to the Buyer.
6. Vertraulichkeit
6.1 Information obtained through the parties’ relationship, especially Purchase Prices and specific sales, is confidential. Each party must take reasonable steps to preserve confidentiality. Public disclosure of these Purchase Terms requires GSM Go Auction’s prior written approval, except for information already public, independently developed or made public without the recipient’s fault.
6.2 Confidential information may be disclosed only under a competent court order or as required by law, and, where permitted, after advance notice to the disclosing party.
7. Zusicherungen, Gewährleistungen und Freistellung
7.1 You agree to indemnify and hold harmless GSM Go Auction, its subsidiaries, affiliates, officers, directors, agents and employees from claims, actions or costs arising from your use of the Site or the sale, export, use or management of Inventory Products, including breaches of export laws.
7.2 This indemnity survives each purchase transaction.
8. Gewährleistungsausschluss und Haftungsbeschränkung
8.1 Except as expressly stated in these Terms, Inventory Products are supplied “as is” and “where is”. GSM Go Auction disclaims all express, implied, statutory and other warranties, including those of non-infringement, merchantability and fitness for a particular purpose. Neither party is liable for consequential, indirect, special, incidental or punitive damages. GSM Go Auction’s total liability for a relevant lot shall not exceed the Purchase Price paid for it.
9. Verstoß gegen die Einkaufsbedingungen
9.1 If you fail to comply with these Purchase Terms, GSM Go Auction may immediately delete your account, deactivate your password and use any other available remedy.
10. Allgemeine Bestimmungen
10.1 These Purchase Terms are governed by the laws of the Italian Republic. Any action or proceeding shall be brought before the Court of Treviso, Italy. A waiver is effective only if made in writing and signed.
10.2 GSM Go Auction is not liable for a failure or delay caused by events beyond its reasonable control, including acts of God, strikes, civil disturbance, fire, flood, explosion, governmental acts, shortage of fuel, energy, transport or supplies.
